Terms & Conditions

ProShine Mobile Detailing · Service Area: Texas

These Terms & Conditions govern all services provided by ProShine Mobile Detailing (“ProShine,” “we,” “us,” or “our”) to each customer (“Customer,” “you,” or “your”). By booking, purchasing, authorizing, or receiving any service from ProShine, you agree to these Terms. ProShine provides premium mobile car detailing services focused on cosmetic improvement, preservation, and vehicle presentation. Unless expressly stated in writing, our services are detailing services, not mechanical repair, body repair, paint restoration, mold remediation, biohazard remediation, or guaranteed defect removal.

1. Service Authorization

By scheduling an appointment, submitting payment, checking the website acknowledgment box, or otherwise authorizing service, you authorize ProShine to access and perform the selected detailing services on the vehicle provided. You represent that you are the legal owner of the vehicle (or have authority from the owner), that the vehicle is legally parked and accessible at the scheduled service location, that the location permits mobile detailing, and that you have disclosed any known issues affecting safety or quality of service.

ProShine will perform only the services selected, quoted, or agreed to at booking, subject to reasonable adjustments based on vehicle condition. Detailing is intended to improve appearance, cleanliness, and protection — it does not guarantee restoration to new, factory, concours, showroom, or pre-damage condition unless specifically stated in a written service agreement. All service times are estimates, not guarantees.

2. Online Booking, Payment & Deposits

Appointments are not confirmed until the required payment, deposit, or payment authorization has been successfully completed. Certain services (paint correction, large vehicles, high-value appointments, fleet bookings, specialty work) may require a deposit. Deposits reserve appointment time and may be non-refundable, especially when a cancellation, no-show, or reschedule occurs within the cancellation window.

Unless prepaid in full, the remaining balance is due upon completion. ProShine reserves the right to require full payment before beginning work. Online prices assume standard vehicle conditions; pricing may be adjusted for excessive dirt, pet hair, staining, odors, sap, tar, overspray, oversized/lifted vehicles, neglected interiors, work or commercial vehicles, or unusual access. If additional work is required, ProShine will request approval before proceeding.

3. Mobile Service Limitations

The Customer is responsible for ensuring the service location is safe, lawful, accessible, and suitable for mobile detailing, including sufficient space, permission from the property owner/HOA/business, and ensuring pets, children, or bystanders do not interfere. ProShine may refuse, pause, or discontinue service for unsafe, unlawful, hostile, impractical, or materially misrepresented conditions, including severe weather, aggressive animals, threatening conduct, hazardous materials, or biohazard conditions.

Some services require water, electricity, shade, or specific working conditions. ProShine may use its own water, power, and equipment when available, but does not guarantee every service can be completed without site support.

4. Weather Delays & Rescheduling

Mobile detailing is affected by weather. ProShine may delay, reschedule, modify, or cancel due to rain, lightning, high winds, extreme heat or cold, excessive humidity, airborne contamination, or unsafe conditions. Weather-related rescheduling does not automatically entitle the Customer to a refund if the service can be reasonably rescheduled.

5. Vehicle Condition Acknowledgment

You acknowledge that your vehicle may have pre-existing defects not visible before cleaning, polishing, extraction, or coating — including scratches, swirls, rock chips, dents, oxidation, paint or clear-coat failure, prior repair defects, thin paint, water spots or etching, stained interior materials, worn leather/vinyl/carpet, loose trim, cracked seals, electrical issues, or fragile electronics. ProShine is not responsible for pre-existing damage, deterioration, manufacturing defects, prior repair defects, age-related wear, or damage hidden by dirt, wax, fillers, or contamination. Cleaning may reveal defects that were already present.

6. Paint, Polishing & Correction Disclaimer

Paint correction, polishing, clay treatment, decontamination, and gloss enhancement are intended to improve appearance — they do not guarantee complete removal of all defects. Some defects are too deep, too severe, or too risky to remove safely. ProShine reserves the right to decline aggressive correction if it could compromise paint integrity.

7. Interior Stain, Odor & Material Limitations

Interior cleaning, steam cleaning, shampooing, extraction, and spot treatment may improve stains, but complete removal is not guaranteed — some stains (dye transfer, ink, coffee, wine, grease, bleach, mold, pet accidents, long-term neglect) are permanent. Odor treatments may reduce odors but do not guarantee complete or permanent elimination; odors may return from contamination in foam, padding, vents, headliners, cushions, or insulation. ProShine is not responsible for deterioration, discoloration, cracking, or failure of already compromised interior surfaces.

8. Biohazard & Excessive Filth Policy

ProShine reserves the right to refuse or stop service for suspected or confirmed biohazard conditions (blood, vomit, urine, feces, needles, drug residue, mold, heavy mildew, decomposing matter, pest infestation, bodily fluids, or hazardous chemicals). Vehicles with extreme dirt, trash, food waste, pet hair, odor, or contamination may require additional charges or a modified service plan. ProShine is a detailing company, not a licensed biohazard remediation company.

9. Aftermarket Parts, Wraps & Accessories

ProShine is not responsible for damage caused by improperly installed, loose, defective, aged, modified, or non-factory parts or accessories — including body kits, trim, emblems, vinyl wraps, decals, paint protection film, window tint, lighting, roof racks, aftermarket electronics, audio equipment, or wiring. Wrapped vehicles and PPF may have pre-existing lifting edges, staining, fading, or adhesive failure. ProShine is not responsible for water intrusion where the vehicle has damaged seals, weatherstripping, prior collision damage, aftermarket wiring, modified lighting, or existing leaks.

10. Luxury, Exotic, Classic & Specialty Vehicles

Luxury, exotic, classic, collector, modified, imported, and specialty vehicles may involve elevated risk due to rare materials, sensitive finishes, aged components, and limited replacement availability. By authorizing service on such a vehicle, you acknowledge that perfect results cannot be guaranteed. ProShine may use a preservation-first approach, avoiding aggressive methods that could create unnecessary risk.

11. Customer Property, Valuables & Firearms

Customers must remove all personal property, valuables, cash, jewelry, electronics, medications, documents, and sentimental items before service. Customers must remove all firearms, ammunition, knives, weapons, and regulated items. ProShine personnel are not responsible for securing, handling, or discovering firearms left in a vehicle and may stop service immediately if such items are discovered. ProShine is not responsible for lost, damaged, misplaced, or discarded personal property left inside the vehicle.

12. Cancellation, Rescheduling & No-Show Policy

Customers must cancel or reschedule at least 24 hours before the scheduled appointment time unless otherwise stated at booking. Cancellations within 24 hours may result in forfeiture of deposit or a cancellation fee. No-shows (Customer unavailable, vehicle inaccessible, access not provided) may result in forfeiture of deposit or full appointment charge. If the Customer is more than 15 minutes late or delays access, ProShine may shorten the service, reschedule, charge a waiting fee, or treat the appointment as a no-show.

13. Satisfaction Policy

Customers are encouraged to inspect the vehicle upon completion and raise concerns before ProShine leaves the location when reasonably possible. Service concerns must be reported within 24 hours of completion; ProShine may request photos, videos, or an in-person inspection. If a legitimate service issue exists, ProShine may, at its discretion, offer a reasonable correction, touch-up, credit, or other commercially reasonable solution. Dissatisfaction caused by permanent stains, odors, scratches, oxidation, paint failure, rock chips, worn interiors, or defects that cannot reasonably be corrected through detailing does not entitle the Customer to a refund.

14. Limitation of Liability

To the fullest extent permitted by Texas law, ProShine’s maximum liability for any claim related to a service shall not exceed the amount paid by the Customer for the specific service giving rise to the claim. ProShine is not liable for loss of use, diminished vehicle value, lost income or profits, rental car costs, towing costs, incidental or consequential damages, emotional distress, or punitive damages (except where such exclusion is prohibited by law). ProShine is not liable for damage caused by age, wear, neglect, prior repairs, manufacturing defects, environmental exposure, aftermarket modifications, or pre-existing vehicle condition.

15. Indemnification

You agree to defend, indemnify, and hold harmless ProShine, its owners, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of your breach of these Terms, your misrepresentation of vehicle condition, unsafe or unlawful service location conditions, aftermarket parts or modifications, third-party claims involving the vehicle or property, personal property left in the vehicle, or claims made by someone other than the booking Customer.

16. Photography & Media Release

You authorize ProShine to photograph or record the vehicle before, during, and after service for documentation, quality control, training, marketing, and portfolio purposes. ProShine may use photos or videos on its website, social media, advertising, and marketing materials, and will make reasonable efforts not to publicly display license plates, addresses, personal items, or identifying customer information without permission. Customers may request in writing before service that their vehicle not be used for marketing; documentation photos may still be taken for internal quality control and liability protection.

17. Intellectual Property

All ProShine names, logos, website content, service menus, photographs, videos, graphics, pricing structures, copy, designs, branding, and other materials are the property of ProShine or its licensors. Customers may not copy, reproduce, distribute, modify, or use ProShine intellectual property without written permission.

18. Force Majeure

ProShine is not responsible for delay, nonperformance, interruption, or rescheduling caused by events beyond its reasonable control, including weather, natural disasters, power outages, water restrictions, equipment failure, supplier delays, illness, labor shortages, road closures, accidents, government orders, emergencies, or acts of God.

19. Dispute Resolution & Arbitration

Before filing any formal claim, the parties agree to make a good-faith effort to resolve disputes informally. Customers must first contact ProShine in writing with a description of the issue, supporting documentation, the service date, and the requested resolution. To the fullest extent permitted by law, any dispute shall be resolved by binding individual arbitration in Texas, rather than in court, except where prohibited by law or where a party seeks relief in small claims court. Disputes shall be brought only on an individual basis; the Customer agrees not to participate in a class action, class arbitration, collective action, or representative proceeding against ProShine.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any permitted court proceeding shall be brought in a court of competent jurisdiction in Texas.

21. Waiver, Severability & Entire Agreement

ProShine’s failure to enforce any provision does not waive the right to enforce it later. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with any written quote, invoice, service description, or online booking confirmation, form the entire agreement between the Customer and ProShine regarding the services.

22. Right to Update Terms

ProShine may update these Terms from time to time. The version posted on the website at the time of booking will generally apply to that appointment unless otherwise required by law.

Plain English Summary

Detailing improves appearance but does not guarantee perfect restoration. Some scratches, stains, odors, and paint defects may be permanent. Pre-existing damage is not ProShine’s responsibility. Mobile service depends on safe access, weather, and vehicle condition. Prices may increase if the vehicle is much dirtier or more complex than expected. Please remove valuables, firearms, and personal items before service. If something seems wrong, contact us within 24 hours. Our maximum liability is limited to the amount paid for the service.
